Welcome to ArtPort ("we," "us," "our"). By accessing or using our services, including placing orders for art shipments, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you should not use our services.

1. Service overview

ArtPort provides a platform for facilitating the shipment of fine art, offering services that include sending empty boxes to customers, documenting the packing process, and arranging the shipment of packed artwork via third-party carriers.

We also provide third-party insurance coverage for artwork during shipping, requiring you to upload photos for insurance purposes.

2. Account and order responsibilities

2.1 Account creation

To use certain services, you may be required to create an account. You must provide accurate, current, and complete information and maintain the security of your account credentials.

2.2 Order accuracy

You agree to provide correct shipping, billing information, and other details related to your orders. We are not responsible for delays or issues arising from inaccurate information.

2.3 Order updates

Upon placing an order, you will receive a confirmation email, as well as additional emails as the status of an order changes.

3. Customer obligations

3.1 Packing the artwork

After receiving an empty box from us, you are responsible for securely packing your artwork. You must follow our packing guidelines to ensure the safe shipment of the artwork.

3.2 Photo uploads

Upon receipt of the empty box, you must upload clear and accurate photos of the artwork before it is packed, as well as after it is packed. These photos must be uploaded within 30 days of receiving the box.

Failure to upload the photos in time will void the order, any insurance coverage, as well as your right to pursue a claim.

Once the artwork has been delivered, the recipient must send, and you must upload, clear and accurate photos of the artwork before it is unpacked, as well as after it is unpacked. These photos must be uploaded within 24 hours of receiving the box.

4. Shipping and delivery

4.1 Shipping process

We will arrange for the shipment of your packed artwork with third-party carriers. Shipping times may vary depending on the carrier, destination and service that you have selected.

4.2 Carrier responsibility

Once the artwork is handed over to the carrier, they assume full responsibility (as per their terms and conditions) for delivery.

We are not liable for delays, damages, or losses during transit. However, we will file claims for damages or losses on your behalf, providing that the correct documentation has been supplied.

4.3 Delivery confirmation

You must ensure that someone is available to receive the shipment and that they are capable of signing for it. We are not responsible for any issues arising from unsuccessful delivery attempts.

5. Pricing and payments

5.1 Pricing

Prices for our services are as listed on our website or quoted at the time of purchase. Prices may change without prior notice, but changes will not affect orders already placed.

5.2 Payment

Payments are due at the time of order. We accept various payment methods, and you agree to provide accurate payment information.

We are not responsible for any fees, taxes, or charges that may be imposed by your payment provider.

6. Insurance

6.1 Coverage

Our insurance coverage applies only to the shipment process and is contingent on your adherence to the packing and photo upload requirements. Coverage limits may apply, and exclusions may apply in cases of negligence or improper packing.

6.2 Claim process

7. Limitation of liability

To the fullest extent permitted by law, ArtPort is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services, including delays, loss, or damage to artwork during transit, or issues with insurance claims.

Our liability is limited to the value of the service provided, and we are not responsible for any loss or damage beyond that.

8. Intellectual property

All content, including text, images, logos, and software, on our website is the property of ArtPort or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content without our written consent.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time if you violate these Terms or for any other reason, without prior notice. Upon termination, you will no longer have access to your account and any orders in progress.

10. Legal compliance

Should we be served with a subpoena, warrant or other legal action related to you, your shipments, or this agreement, then you agree to pay our actual costs and reasonable attorneys’ fees incurred as a result of our attorneys’ defense of, or compliance with, said actions.

You shall indemnify, defend and hold us harmless, against all claims including, but not limited to any third-party claims.

11. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use our services.

12. Governing law

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from the use of our services shall be resolved in the courts of the State of Florida.

13. Modifications to these terms

We may update or modify these Terms at any time. Changes will be posted on this page, and the effective date will also be updated. It is your responsibility to review these Terms periodically.
